Second Murder Trial Awaits Date

Six months after a new trial was ordered for Matthew Foerster, there is still no date set for that.

The former Cherryville resident was convicted of the first degree murder of Taylor Van Diest of Armstrong in 2014, but was granted a new trial in March by the BC Court of Appeal due to errors made by the judge in instructions to the jury.

Lawyers have been in court at least ten times since then, but have yet to fix a date.

Crown counsel says Foerster is scheduled to appear in court by video next week to confirm possible trial dates.

The file was adjourned to September 27 for a pre-trial conference for counsel to sort out trial dates, says Alisia Adams, Acting Communications Counsel for the BC Prosecution Service.  “Mr. Foerster is then scheduled to appear by video on October 2 to confirm those dates. ”
