Vernon woman files lawsuit claiming fall at Mark’s Work Warehouse led to emergency C-section

A Vernon woman has launched a lawsuit against Canadian retail giant Mark’s Work Warehouse.

According to the notice of claim filed Feb. 5 2020, Celeste Shantal Hind was 34 weeks pregnant when she allegedly tripped over some shoe boxes at the store and fell on her abdomen, resulting in an emergency pre-term Cesarean Section the same day.

The alleged incident happened at the Mark’s Work Warehouse in Salmon Arm two years ago on Feb. 6, 2018.

The Picadilly Place Mall, where the store is located, is also listed as a defendant in the lawsuit.

Hind claims the fall resulted in several injuries including placental abruption, emergency Cesarean surgery, trauma, pain and injury to her abdomen, headaches, and sleep disturbances.

The claim states the alleged incident caused and continues to cause pain, suffering, discomfort, loss of enjoyment of life, and permanent disability.

The plaintiff struggles to maintain household chores and she had to rely on family assistance since the alleged incident, the claim states.

The lawsuit seeks financial compensation for general damages, special damages, health care costs, future care costs, an in-trust claim for family members and others.

Mark’s Work Warehouse, and the Piccadilly Place Mall have yet to respond to the lawsuit.

None of the allegations have been proven in court.
