Sentencing in assault with a weapon trial pushed back

The sentencing in a Vernon court case won’t be handed down as soon as originally expected.

Dale Babiy was found guilty of assault with a weapon and uttering threats at a trial in Vernon law courts that concluded March 24.

Babiy was to appear in court Monday, March 31, to set a sentencing hearing date.

However, the B.C. Prosecution Service said Babiy’s counsel requested the court order pre-sentence reports, which was granted.

Babiy and his counsel were scheduled to appear in court on April 4 to receive those reports.

The Prosecution Service said the case would likely be adjourned again following that appearance and go back before a judicial case manager before a sentencing date could be set.

Babiy is also facing charges including flight from police during an arrest in December. That case has een adjourned until April 3 when an arraignment hearing will be held.
