Sex assault conviction overturned, new trial ordered
A Coldstream resident found guilty of sexual assault last year, has had the conviction overturned by the B.C. Court of Appeal and will get a new trial.
Keith Chase, who is a Vernon business owner, was successful in appealing his 2022 BC Supreme Court conviction involving a female who was 16 years old at the time in 2004.
Chase was the girl’s hockey coach and a friend of her family at the time.
“On appeal, the central question is whether the judge impermissibly relied on the complainant’s prior consistent statements to her parents when she disclosed the events to them in 2008, and if so, whether the curative proviso can be used to uphold the conviction,” the B.C. Appeal Court ruling said.
